I. Definiciones
- KONTESTO: Plataforma de agentes de inteligencia artificial para atención al cliente, operada por Raquel Parra Santiago.
- Cliente: Persona física o moral que contrata los servicios de KONTESTO para su negocio.
- Usuario Final: Persona que interactúa con el agente de IA a través de los canales del Cliente (WhatsApp, Facebook, Instagram, webchat).
- Agente: Sistema de inteligencia artificial autónomo configurado y operado por KONTESTO para atender a los Usuarios Finales del Cliente.
- Plataforma: Conjunto de software, algoritmos, modelos de IA y sistemas que conforman el servicio KONTESTO.
- Canales: Medios de comunicación a través de los cuales el Agente interactúa con los Usuarios Finales (WhatsApp, Facebook Messenger, Instagram Direct, webchat).
II. Aceptación
Al contratar cualquier plan de KONTESTO, el Cliente acepta íntegramente los presentes Términos de Servicio,
el Contrato de Prestación de Servicios y el
Aviso de Privacidad. El uso continuado del servicio constituye aceptación
de cualquier modificación posterior debidamente notificada.
III. Descripción del Servicio
KONTESTO provee un agente de inteligencia artificial autónomo diseñado para atender a los clientes del
negocio contratante a través de canales de mensajería. El agente es capaz de:
- Responder preguntas sobre productos, servicios, precios y horarios del negocio
- Agendar citas y gestionar disponibilidad (según el plan contratado)
- Aprender y mejorar continuamente a partir de las interacciones
- Recordar preferencias de los clientes frecuentes
- Escalar consultas al dueño del negocio cuando no tiene la respuesta
- Generar reportes de actividad y tendencias
IV. Requisitos del Cliente
Para contratar los servicios de KONTESTO, el Cliente debe:
- Ser mayor de edad (18 años cumplidos)
- Operar un negocio legítimo y lícito
- Proporcionar información veraz y actualizada sobre su negocio
- Ser titular o tener autorización para vincular los canales de comunicación (número de WhatsApp, páginas de Facebook, cuentas de Instagram)
- Contar con los permisos necesarios para compartir información de su negocio con KONTESTO
V. Obligaciones de KONTESTO
- Disponibilidad: Mantener el servicio operativo de manera razonable, con un objetivo de disponibilidad del 99% mensual, excluyendo mantenimientos programados y causas de fuerza mayor.
- Soporte: Brindar soporte técnico al Cliente según el nivel incluido en su plan contratado.
- Confidencialidad: Proteger la información del negocio del Cliente y mantenerla aislada de otros clientes.
- Mejora continua: Trabajar constantemente en la mejora del agente y la calidad de las respuestas.
- Transparencia: Informar al Cliente sobre cambios relevantes en el servicio con anticipación razonable.
VI. Obligaciones del Cliente
- Uso lícito: No utilizar el servicio para envío de spam, fraude, estafas, actividades ilegales o cualquier propósito contrario a la ley.
- Información actualizada: Mantener actualizados los datos de su negocio (catálogo, precios, horarios, preguntas frecuentes) para que el agente brinde información correcta.
- No extracción: No intentar copiar, extraer, descompilar o hacer ingeniería inversa de los algoritmos, modelos o sistemas de KONTESTO.
- Pago oportuno: Realizar los pagos en las fechas acordadas.
- Colaboración: Responder las escalaciones del agente de manera oportuna para facilitar el aprendizaje del sistema.
VII. Propiedad Intelectual
Plataforma y algoritmos: La plataforma, código fuente, algoritmos de inteligencia artificial,
modelos de aprendizaje y toda la tecnología subyacente son propiedad exclusiva de KONTESTO.
Ningún derecho de propiedad intelectual se transfiere al Cliente por el uso del servicio.
- Datos del negocio: La información proporcionada por el Cliente (catálogo, precios, FAQs, datos de contacto) es y seguirá siendo propiedad del Cliente.
- Base de conocimiento generada: Las respuestas aprendidas y la base de conocimiento construida durante la prestación del servicio se licencian al Cliente durante la vigencia del contrato. Al terminar la relación comercial, esta base de conocimiento se elimina conforme a la sección IX.
- Datos de conversaciones: Las conversaciones con Usuarios Finales pueden ser utilizadas por KONTESTO de forma anonimizada para mejorar el servicio, conforme al Aviso de Privacidad.

IX. Cancelación
- Sin penalización: El Cliente puede cancelar el servicio en cualquier momento sin penalización alguna.
- Aviso previo: Se solicita un aviso con al menos 15 días naturales de anticipación al siguiente periodo de facturación.
- Eliminación de datos: Una vez cancelado el servicio, todos los datos del Cliente (catálogo, conversaciones, base de conocimiento) se eliminarán en un plazo máximo de 30 días naturales.
- Número de WhatsApp: El número de WhatsApp es propiedad del Cliente. Al cancelar, se desvincula del sistema y el Cliente mantiene pleno control sobre él.
- Datos fiscales: Los datos fiscales y registros de facturación se conservan por el periodo legalmente requerido (5 años).
X. Garantía de Satisfacción
7 días de garantía: Si en los primeros 7 días naturales a partir de la activación del servicio
el Cliente no está satisfecho, KONTESTO devuelve el 100% de la renta mensual pagada, sin preguntas.
XI. Limitación de Responsabilidad
- KONTESTO no garantiza que las respuestas del agente sean 100% exactas o libres de error en todo momento. El agente es un sistema de inteligencia artificial en constante aprendizaje.
- KONTESTO no es responsable por decisiones comerciales, financieras o de cualquier otra índole que el Cliente o sus Usuarios Finales tomen con base en las respuestas del agente.
- La responsabilidad máxima de KONTESTO ante el Cliente, por cualquier concepto, se limita al monto de la última mensualidad pagada.
- KONTESTO no será responsable por interrupciones del servicio causadas por terceros (Meta, proveedores de internet, etc.) o por causas de fuerza mayor.
XII. Uso Aceptable
Queda expresamente prohibido:
- Spam: Usar el agente para enviar mensajes masivos no solicitados o publicidad invasiva.
- Contenido ilegal: Difundir contenido que viole leyes mexicanas o internacionales, incluyendo contenido fraudulento, difamatorio, discriminatorio o que promueva actividades ilícitas.
- Reventa: Revender, sublicenciar o redistribuir el servicio de KONTESTO a terceros sin autorización escrita.
- Ingeniería inversa: Intentar descompilar, desensamblar o extraer el código fuente, algoritmos o modelos de inteligencia artificial de la plataforma.
- Extracción de datos: Usar métodos automatizados para extraer datos, modelos o respuestas aprendidas del sistema.
- Abuso del sistema: Intentar sobrecargar, interferir o comprometer la seguridad de la plataforma.
XIII. Datos y Privacidad
El tratamiento de datos personales se rige por el Aviso de Privacidad de KONTESTO,
elaborado en cumplimiento con la Ley Federal de Protección de Datos Personales en Posesión de los
Particulares (LFPDPPP). El Cliente declara haber leído y aceptado dicho aviso al momento de contratar el servicio.
Para usuarios finales, está disponible el Aviso de Privacidad Simplificado.
XIV. Modificaciones
KONTESTO se reserva el derecho de modificar los presentes Términos de Servicio.
Cualquier cambio sustancial será notificado al Cliente con al menos 30 días naturales
de anticipación a través de correo electrónico y/o publicación en el sitio web.
El uso continuado del servicio después de la entrada en vigor de las modificaciones
constituye aceptación de las mismas.
XV. Legislación Aplicable y Jurisdicción
Los presentes Términos de Servicio se rigen por las leyes vigentes de los Estados Unidos Mexicanos.
Para la interpretación y cumplimiento de los mismos, las partes se someten a la jurisdicción de los
tribunales competentes de la ciudad de Monterrey, Nuevo León, México,
renunciando expresamente a cualquier otro fuero que por razón de su domicilio presente o futuro pudiera corresponderles.

I. Definitions
- KONTESTO: Artificial intelligence agent platform for customer service, operated by Raquel Parra Santiago.
- Client: Individual or legal entity that contracts KONTESTO services for their business.
- End User: Person who interacts with the AI agent through the Client's channels (WhatsApp, Facebook, Instagram, webchat).
- Agent: Autonomous artificial intelligence system configured and operated by KONTESTO to serve the Client's End Users.
- Platform: Set of software, algorithms, AI models, and systems that comprise the KONTESTO service.
- Channels: Communication means through which the Agent interacts with End Users (WhatsApp, Facebook Messenger, Instagram Direct, webchat).
II. Acceptance
By contracting any KONTESTO plan, the Client fully accepts these Terms of Service,
the Service Agreement, and the
Privacy Policy. Continued use of the service constitutes acceptance
of any subsequent modification duly notified.
III. Service Description
KONTESTO provides an autonomous artificial intelligence agent designed to serve the contracting
business's customers through messaging channels. The agent is capable of:
- Answering questions about the business's products, services, prices, and hours
- Scheduling appointments and managing availability (according to the contracted plan)
- Continuously learning and improving from interactions
- Remembering preferences of frequent customers
- Escalating queries to the business owner when it doesn't have the answer
- Generating activity reports and trends
IV. Client Requirements
To contract KONTESTO services, the Client must:
- Be of legal age (18 years old)
- Operate a legitimate and lawful business
- Provide truthful and up-to-date information about their business
- Be the owner or have authorization to link the communication channels (WhatsApp number, Facebook pages, Instagram accounts)
- Have the necessary permissions to share their business information with KONTESTO
V. KONTESTO's Obligations
- Availability: Maintain the service operational in a reasonable manner, with an availability target of 99% monthly, excluding scheduled maintenance and force majeure events.
- Support: Provide technical support to the Client according to the level included in their contracted plan.
- Confidentiality: Protect the Client's business information and keep it isolated from other clients.
- Continuous improvement: Constantly work on improving the agent and response quality.
- Transparency: Inform the Client of relevant service changes with reasonable advance notice.
VI. Client's Obligations
- Lawful use: Not use the service for spam, fraud, scams, illegal activities, or any purpose contrary to the law.
- Updated information: Keep business data up to date (catalog, prices, hours, FAQs) so the agent provides correct information.
- No extraction: Not attempt to copy, extract, decompile, or reverse engineer KONTESTO's algorithms, models, or systems.
- Timely payment: Make payments on the agreed dates.
- Collaboration: Respond to agent escalations in a timely manner to facilitate system learning.
VII. Intellectual Property
Platform and algorithms: The platform, source code, artificial intelligence algorithms,
learning models, and all underlying technology are the exclusive property of KONTESTO.
No intellectual property rights are transferred to the Client through the use of the service.
- Business data: Information provided by the Client (catalog, prices, FAQs, contact data) is and will remain the Client's property.
- Generated knowledge base: Learned responses and the knowledge base built during service delivery are licensed to the Client during the contract term. Upon termination of the business relationship, this knowledge base is deleted according to Section IX.
- Conversation data: Conversations with End Users may be used by KONTESTO in anonymized form to improve the service, in accordance with the Privacy Policy.

IX. Cancellation
- No penalty: The Client may cancel the service at any time without penalty.
- Prior notice: A notice of at least 15 calendar days prior to the next billing period is requested.
- Data deletion: Once the service is cancelled, all Client data (catalog, conversations, knowledge base) will be deleted within a maximum of 30 calendar days.
- WhatsApp number: The WhatsApp number is the Client's property. Upon cancellation, it is unlinked from the system and the Client maintains full control over it.
- Tax data: Tax data and billing records are retained for the legally required period (5 years).
X. Satisfaction Guarantee
7-day guarantee: If within the first 7 calendar days from service activation
the Client is not satisfied, KONTESTO refunds 100% of the monthly fee paid, no questions asked.
XI. Limitation of Liability
- KONTESTO does not guarantee that the agent's responses will be 100% accurate or error-free at all times. The agent is an AI system in constant learning.
- KONTESTO is not responsible for commercial, financial, or any other decisions that the Client or their End Users make based on the agent's responses.
- KONTESTO's maximum liability to the Client, for any reason, is limited to the amount of the last monthly payment made.
- KONTESTO shall not be responsible for service interruptions caused by third parties (Meta, internet providers, etc.) or force majeure events.
XII. Acceptable Use
The following is expressly prohibited:
- Spam: Using the agent to send unsolicited mass messages or invasive advertising.
- Illegal content: Distributing content that violates Mexican or international laws, including fraudulent, defamatory, discriminatory content, or content promoting illegal activities.
- Resale: Reselling, sublicensing, or redistributing the KONTESTO service to third parties without written authorization.
- Reverse engineering: Attempting to decompile, disassemble, or extract the source code, algorithms, or AI models of the platform.
- Data extraction: Using automated methods to extract data, models, or learned responses from the system.
- System abuse: Attempting to overload, interfere with, or compromise the platform's security.
XIII. Data and Privacy
The processing of personal data is governed by KONTESTO's Privacy Policy,
prepared in compliance with the Mexican Federal Law for the Protection of Personal Data Held by
Private Parties (LFPDPPP). The Client declares having read and accepted said notice at the time of contracting the service.
For end users, the Simplified Privacy Notice is available.
XIV. Modifications
KONTESTO reserves the right to modify these Terms of Service.
Any substantial change will be notified to the Client at least 30 calendar days
in advance through email and/or publication on the website.
Continued use of the service after the modifications take effect
constitutes acceptance thereof.
XV. Applicable Law and Jurisdiction
These Terms of Service are governed by the current laws of the United Mexican States.
For their interpretation and enforcement, the parties submit to the jurisdiction of the
competent courts of the city of Monterrey, Nuevo León, Mexico,
expressly waiving any other jurisdiction that may correspond to them by reason of their
present or future domicile.
